Privacy Policy


You can access the products and services that are available as part of the Living it Up Programme through livingitup.scot and livingitup.org.uk (the "LIU Domain"). That domain is managed by:

  • NHS 24, whose principal place of business is Living it Up Programme Office, Caledonia House, 140 Fifty Pitches Road, Cardonald Park, Glasgow, G51 4EB (Data Protection Registration Number: Z8707451)

For the purposes of the Data Protection Act 1998, NHS 24 is operating as Data Controllers in common, meaning that each entity is separately responsible for the way in which your data is collected, stored and processed.

As part of the programme, NHS 24 may provide data collected through the operation of the LIU Domain to any NHS Health Board or Trust, in order to allow that Health Board or Trust to provide its services to you. In those circumstances the Health Board or Trust concerned will also be operating as a Data Controller, and will process any personal data in accordance with its own privacy policy and data governance protocols.

This Privacy Policy, together with our Terms and Conditions and Cookies Policy (detailed later in this document) , sets out our data processing practices, including how and for what purposes we use the information collected about you.


Information Collected

We and NHS 24 collect personal information that you submit and through your use of the LIU Domain. We will use this information for the purpose of improving the quality of the services we provide to you.

We will collect the following information that you submit via the LIU Domain:

  • Contact details (such as email address and name)Demographics (such as your postcode and reason for using LiU)
  • Your consents (such as acceptance of Terms & Conditions)
  • Messages that you send us in emails or by filling in online forms
  • Comments posted publicly on the website
  • Interests and preferences (such as Quiz results and your alias)
  • Tracking information (such as when you created an account and logged in the last time)
  • Personal notes (such as your Activity Log)

We will collect the following information automatically from your computer:

  • Information from cookies (see below for a fuller explanation of cookies and their function).
  • Your IP address. This is the unique address of your computer and is automatically provided to other computers when your web browser or email application requests a web page or email from those computers on the Internet.
  • Information about the type of device and browser you are using.

Use of personal information

We shall use any personal information we collect in accordance with this Privacy Policy. Save as expressly allowed under this Privacy Policy or required by law, we shall not disclose your personal information to any third parties without obtaining your prior consent, unless required to do so by law.

We may use the information described above to:

  • create and manage your profile;
  • provide products and services;
  • send promotional materials and other communications;
  • communicate with you about and administer your participation in special events, programmes, offers, surveys and market research;
  • respond to your enquiries;
  • operate, evaluate and improve our services and products;
  • perform data analyses for strategic development purposes to measure the effectiveness of content/ideas and to provide you with a more personalised service; and
  • create anonymised data which we may then disclose to organisations who support the LIU Programme, allowing us to improve and extend the services and products made available through the LIU Domain.


Information we share

We do not disclose the personal information we collect about you, except as described in this Privacy Policy or as required by law.

We may share your personal information with our affiliates for the purposes described in this Privacy Policy. We may also share your personal information with service providers who perform services on our behalf based on our instructions. We do not authorise these service providers to use or disclose personal information except as necessary to perform services on our behalf or to comply with legal requirements. We impose strict legal obligations on these service providers requiring them to implement robust security measures designed to protect your personal information.

We store the personal information we collect on computer systems with limited rights of access; located in controlled and secure facilities. When we transmit confidential information over the internet, we protect it through the use of encryption technology such as the Transport Layer Security (TLS) protocol.

If a password is given to you to help protect your accounts and personal information, it is your responsibility to keep that password confidential. Do not share that information with anyone. If you are sharing a computer with anyone, you should always log out before leaving a site or service to protect your information from being accessed by other users.


Can I remove my information?

Of course, we believe that you should be in control of your data and should be able to delete it at any time. If you are a registered user of Living it Up you can delete your profile at any time by selecting the delete option at the bottom of your profile page when logged in. If you have any difficulty with this please email support@livingitup.org.uk  and we will be happy to help. If you are a member of Living it Up we can delete any personal information which we hold about you, please email us at support@livingitup.org.uk with your request. You also may at any time request access to all personal information on you by NHS 24, by email - dp@nhs24.scot.nhs.uk or by writing to Living it Up Programme Office, Caledonia House, 140 Fifty Pitches Road, Cardonald Park, Glasgow, G51 4EB. Further, if your personal details change or if you have any queries about how we use your information, please let us know by contacting us as set out above.


Email communication

We will email you with information about how you can get involved in Living it Up, and to let you know about new changes. We use a tool called campaign monitor to send emails. If you do not wish to receive these mailings you can opt out by clicking on the 'unsubscribe' link at the end of the email. If you have any difficulty with this please email support@livingitup.org.uk and we will be happy to help. Please note unsubscribing from emails does not remove your membership of Living it Up – if you wish to remove your information see the information above.


Commenting policy for user generated content

We encourage you to engage with the Living it Up community by posting comments, questions, recommendations and experiences. Above all, we ask you to be respectful of other commenters. We reserve the right to not publish comments that:

  • Make personal attacks of any nature or that are disrespectful to the writer.
  • Are unlawful, harassing, defamatory, explicit, abusive, threatening, harmful, obscene, profane, triggering or offensive.
  • Advertise for commercial products or services.
  • Include material that the poster does not own the rights to.
  • Includes contact details of the poster, or anyone else, in the body of the post (phone number, email address, etc.).
  • Are off-topic, repetitive or excessively long.


Third Party Links

The LIU Domain contains links to other sites, including those of our third party partners. Linked sites and applications may have their own terms and conditions, which we strongly suggest you read. We are not responsible for the privacy practices of the third parties operating those sites. In particular, unless expressly stated, we are not agents for the operators of those sites nor are we authorised to make representations on their behalf.


Safeguards, security and storage

Although we do our best to protect your personal data, we cannot guarantee the security of the data transmitted to the LIU Domain or any associated Living it Up applications. Any transmission is made at your own risk. However, we will endeavour to protect all personal information collected through the LIU Domain in accordance with strict data protection standards.

All of the information we collect or record is restricted to our regional officers or designated secure hosting. Only employees who need the information to perform a specific job are granted access to personally identifiable information.

We will retain your information for as long as we are providing you with services. If you do not access the services provided through the LIU Domain for a period of over 12 months, we will send you an email asking you to confirm that you wish to continue receiving Living it Up communications. If you do not respond to that email within one month we will unsubscribe you and will remove from the LIU Domain. In any event we will hold your information on our systems until the end of the Living it Up Programme to allow us to carry out statistical analysis and evaluation. We will also retain your information for a longer period if required to by law.

Policies, Notices and Terms of Use

This Living it Up Domain website – www.livingitup.scot and  www.livingitup.org.uk (the "LIU Domain") is operated by NHS 24. These Terms and Conditions, together with our Privacy Policy govern your use of the LIU Domain. We may amend these Terms and Conditions from time to time and the revised version will be effective when displayed here.

By using the LIU Domain, you confirm that you are over the age of 18, or are a parent or legal guardian of a user under the age of 18.


Intellectual Property Rights

Copyright © 2012-2013 by NHS 24, all material on the LIU Domain is protected by UK and other copyrights. Material may be used freely for personal, research, scientific, and/or information purposes only. No part of any material posted on the LIU Domain may be copied, downloaded, stored in a retrieval system, or redistributed for any other purpose without identifying where this information has come from. You may not modify or create derivative works based on the LIU Domain material.

You may not reverse engineer, decompile, copy or adapt any software or other code or scripts that form part of this website nor attempt to transmit to or via our website any information that contains a virus, worm, trojan or other harmful or disruptive component.



The LIU Domain is provided without warranties of any kind, either express or implied, including, but not limited to, warranties of title, or implied warranties of merchantability or fitness for a particular purpose.

The use of the LIU Domain is at your own risk. We cannot guarantee uninterrupted access to this website or the sites to which it links. You may post reviews and comments via our feedback form, as long as any such reviews and comments are not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties.

The LIU Domain contains links to other sites, including those of our third party partners. These allow our third party partners to market their products. Whilst the LIU Domain facilitates transactions between you and third parties, NHS 24 is neither the buyer nor the seller of the seller's items. The contract formed at completion of the sale is solely between the buyer and the seller. NHS 24 is not a party to this contract, nor is it the seller's agent and therefore assumes no liability arising out of or in connection with its terms.

NHS 24 is not the manufacturer of any products sold via the links on the LIU Domain. We cannot ensure the accuracy of information and are not responsible for the content of any third party website. All information about any products is provided for information purposes only. We recommend that you do not rely solely on the information presented on the LIU Domain. Always read labels, warnings and directions provided with the product and consult your healthcare professional before using.

A link to another site in no way constitutes an endorsement of the contents therein.

You agree to hold harmless and indemnify the LIU Domain and their agents and contributors against any liability for any claims and expenses, including reasonable legal fees, relating to any violation of these Terms and Conditions.

Governing Law

These Terms and Conditions shall be governed by the laws of Scotland. You expressly agree to submit to the exclusive jurisdiction of the Scottish Courts. In the event that you believe that you have been irreparably harmed by any cause of action relating to the LIU Domain you agree to inform the LIU Domain in writing at the following address: Living it Up Programme Office, Caledonia House, 140 Fifty Pitches Road, Cardonald Park, Glasgow, G51 4EB and grant the LIU Domain thirty (30) days to cure the harm before initiating any action. Any legal action, suit or proceeding arising out of or relating to these terms and conditions or a breach thereof, shall be initiated in a court of competent jurisdiction in Scotland, and you hereby consent and submit to the personal jurisdiction of such court, waive any objection to venue in such court and consent to service of process by overnight courier or express mail at your last known address. Any cause of action initiated by you must be initiated within one (1) year after the claim or cause of action has arisen or such claim shall be barred.

Any use or viewing of the LIU Domain, HTML pages or features other than the welcome screen and this page shall be taken as acceptance of these Terms and Conditions.
